THIS AGREEMENT SETS FORTH THE LEGALLY BINDING TERMS, CONDITIONS AND PRIVACY FOR YOUR USE OF ALL SERVICES OWNED AND OPERATED THROUGH THE AUSPICES OF THE INSTITUTE FOR VENTURE PHILANTHROPY, LEGACY ADVOCACY, EVENTS GUILD, CULTUREVORE, CULTUREVORE[VENUES], CULTUREVORE[STORE], CULTUREVORE[VENDORS] AND HIGGINBOTHAM HOUSE MUSEUM/ENTERPRISES, LLC.
WHEN ACCESSING THE WEBSITES DEVELOPED AND OPERATED BY THE ABOVE FOR ANY PURPOSE, YOU AGREE TO ACCEPT AND BE BOUND BY THIS AGREEMENT.
THIS AGREEMENT APPLIES TO ALL "USERS" WHO VISIT AND/OR BROWSE OUR WEBSITES AND ALL WEB DIRECTORY "PARTICIPANTS" WHO CONTRIBUTE AND/OR POST CONTENT, INFORMATION, PHOTOGRAPHS AND ALL OTHER INTELLECTUAL PROPERTY FOR PROMOTIONAL PURPOSES.
"Making patronage simple and direct," The Institute for Venture Philanthropy (IVP), an advocacy provider uniting beneficiary and benefactor, developed "Events Guild" and "culturevore" for the purpose of turning consumers into patrons. This is achieved through two web directories: culturevore [venues] and culturevore [store]. Organizations, institutions and enterprises who are stewards of culture, nature and humanity are invited by The Institute for Venture Philanthropy to post information about their places or spaces that can be rented for special occasions or whose unique merchandise can be purchased through their gift shops or stores. The public's desire and ability to help each stewardship grow these two revenue streams results in the sustainability of the world's most cherished resources, while creating for the entire stewardship field a league of new patrons celebrated as "culturevores."
A third culturevore Website: CULTUREVORE[VEDORS] is a directory of services and products utilized by events hosts, producers and planners.
The Institute for Venture Philanthropy (IVP), established in 1999, is dedicated to supporting the proven/qualified/self-proclaimed stewards of culture, nature and humanity through leveraged philanthropy. The IVP is an initiative of Higginbotham House Museum/Enterprises, LLC, established in 1998.
In 2011, the IVP trademarked "Events Guild" and "Culturevore," uniquely acknowledging the power individuals attain when their social consciousness shifts from consumerism to patronage.
Organizations, institutions and enterprises that are committed to the sustainability of culture, nature and humanity (PARTICIPANTS) are invited to enroll in our three culturevore services. USERS of culturevore.com (general public) are shown special event venues and gift shops/stores and vendors with relationships to the stewardship field. It is the responsibility of USERS to determine the integrity and intent of the PARTICIPANTS. USERS are linked to the websites of participating organizations, institutions and enterprises in order to conduct all transactions for their services and goods. USERS becoming venue contractors and merchandise and service customers conduct all communications, financial transactions and fulfillment arrangements with the individual PARTICIPANT vendors. culturevore [venues] and culturevore[store] do not receive financial remuneration for providing this advocacy-based service. Culturevore[vendors] pay a yearly fee to advertise their services and products.
We expend considerable effort to ensure accuracy and integrity for our services. All links in this service are provided with no contractual agreements expressed or implied for all PARTICAPANTS and USERS: The content and services of any organization, institution or enterprise in our web directories are not brokered. Events Guild and Culturevore are not responsible for the content, products and services provided by any external sites/links nor responsible in any way for the relationship established or implied by the USERS of the content products and services of external sites/links. All text, images and all other content on our websites are provided "as is" without warranty of any kind, either expressed or implied, including but not limited to, the implied warranties or merchantability, fitness for a particular use, and/or non-infringement. (When PARTICIPANTS submit content for their individual profile pages, we have assumed that all relevant photo and text permissions-for-use, releases, copyrights and trademarks have been granted for use on all of the websites owned or managed by Higginbotham House Museum/Enterprises, LLC.) We do not warrant that our websites will be uninterrupted or free of errors, or that any errors or defects will be corrected. Please note that use of all our websites are at your sole risk.
Higginbotham House Museum/Enterprises, LLC assumes no responsibility, and shall not be liable for any errors or omissions in the content on all the websites it owns or operates, or damage to or viruses that may infect your computer equipment or other property on account of your use of our websites or your downloading of any text, images or other content from our websites. By downloading, printing or otherwise using any of the content from our websites, you agree that you restrict your use of such content to personal and non-commercial use, comply with all the terms, conditions and privacy expressed herein, and not violate the rights of any person or entity. NOTE-PARTICIPANTS: We collect "Personally Identifiable Information" about you (for example, your web address, your name, physical address, telephone number, email address, etc.) that all registrants provide when completing our online registration forms/platforms or when indicating a contact request. If you would like to modify any information that you gave us on a registration form/platform, you may do so by completing a new registration and submitting it to us unless instructed otherwise. For culturevore[store] and culturevore[vendors] participants, a username/password is required. You are responsible for maintaining the confidentiality of your username/password. It is assumed that permissions-for-use, releases, copyrights and trademarks for all promotional materials (content) submitted/posted on any of our websites by PARTICIPANTS, such as photographic images that show individuals or groups of people, protected materials, logos, etc., are owned or permission-granted by the PARTICIPANTS. By submitting/posting your promotional materials, you are granting our permission for their presentation on our websites. Copyrights, trademarks, and photo credits will be displayed on our websites when appropriate and when provided by PARTICIPANTS.
Content of any kind that we find unacceptable for any reason will be denied or removed.
NOTE-THIRD PARTIES: Events Guild and Culturevore appreciate the interests others may have in linking to www.culturevore.com. (In fact, it is highly encouraged for PARTICIPANTS to promote their Culturevore association in their print and electronic publications provided to their constituents.)
All THIRD-PARTIES providing a link, may not list Culturevore or Events Guild and their Participants’ names, or any variations thereof, in a false, disparaging, unsuitable, or otherwise unfavorable light, or in any other manner that is reputation damaging. If you wish to use any of the content for commercial use, publication or any purpose other than personal use, you must obtain written permission from Higginbotham House Museum/Enterprises, LLC prior to such use. We may, in our sole discretion, grant permission for such use on a case-by-case basis and may charge a usage fee for such use.
These terms, conditions and privacy provisions are governed by the laws of Virginia, without regard to its conflicts of laws principals. Any case, controversy, suit, action or proceeding arising out of, in connection with, or related to these terms, conditions and privacy provisions shall be brought in federal or state court located in Tazewell County, Virginia and you hereby waive any objection to the exclusive jurisdiction of such courts.
